Bruhhost.com. agrees to furnish services to the Subscriber, subject to the following (“Terms of Service”). Bruhhost.com, the company hereafter referred to as, (“Bruhhost.com“), (“Us”), (“We”) and The Client, (“Customer”), (“Client”) and (“You”). Use of Bruhhost.com Services constitutes acceptance and agreement to AUP (“Acceptable Use Policy”) and ToS (“Terms of Service”). All provisions of this contract are subject to change from time to time at the discretion of Bruhhost.com. Subscriber understands that change to the ToS by Bruhhost.com shall not be grounds for early contract termination or non-payment.

REFUNDS AND DISPUTES
All hosting service orders placed by newly registered customers are eligible for refunds within 5 Days of the creation of the server in our database, this point is not marked by the time at which your initial payment is processed and may differ by several hours or days. All refunds are made through the gateway in which initial payments were made. All of our other services, including product addons and domains are not eligible for a refund. Refunds cannot be requested without probable cause; in addition to this non-monthly terms are non-refundable. Our 5 Days money-back guarantee applies to a new client’s first order only. To request a refund, you must submit a refund request via the support ticket system outlining the reason. If you meet the terms of eligibility, a refund will be issued by a team member. Refunds will not be issued automatically. Refunds issued for billing errors are made on a per case basis. Refunds will be credited to the original payment method within 7 working days.
CANCELLATIONS
To terminate your services you must cancel via our WHMCS billing area at http://billing.bruhhost.com using the cancellation request form. A cancellation request must be submitted when a client wishes to no longer proceed with their service. Accounts with a credit card on file will automatically attempt to renew until cancelled. Unless specified per special arrangement, we do not hold our clients accountable to any contracts. Our customers can cancel at any time.
EXPLOITATION
Clients are disallowed from exploiting services to modify settings of features beyond which they are permitted in their rental agreement. For instance, a client may not modify their slot count to an amount that differs from what they are renting from us.
LIABILITY LIMITATION AND EXCLUSION
Bruhhost.com, under no circumstances, shall be held liable for any data loss, disruption of information, or distribution of information including that of unauthorized access to our server systems or any other loss of data. Bruhhost.com shall not be held liable for any disruption, delay, or disconnection of services for any period of time. We reserve the right to terminate a client’s services in the event of a charge dispute, despite the outcome of the dispute.
SUPPORT
Any support requests required for products from Bruhhost.com shall be submitted through the billing system via tickets. Any other form of contact other than the predetermined ticket system is not guaranteed a proper answer from an official representative.
PROMOTIONS
Bruhhost.com cannot guarantee that all promotion codes will work all of the time.
LEGAL CONTACT
Bruhhost.com retains the right to seek and consult with any appropriate authorities that may need to be involved in the event of an issue arising whether it is through violation of this policy or any other illegal occurrence requiring the involvement of law-enforcement agencies. Bruhhost.com regards any communication between parties as confidential, upon distribution of any communication, unless prior approval is in place, we will take action to the full extent of the law. By purchasing a server from Bruhhost.com you permit us to modify your server, this includes, but is not limited to, changing settings, uploading/mods, and other tasks related to running any server. Any verbal or written action to compromise our server systems or any other equipment owned by Bruhhost.com will be taken seriously and will result in further investigation and possible lawsuits. Upon cancellation of payments to Bruhhost.com your server will be suspended unless prior arrangements are made. Files will be kept as long as possible after termination or suspension however the guaranteed amount of time is unspecified. Bruhhost.com retains the sole right to stop, start, and modify your server at any given time.
We do not support the use of any custom jar file or files uploaded by the user. Any uploaded files that cause the server to lag or make the server unplayable are not the responsibility of Bruhhost.com. Unfair usage If we find your server using any sort of system to bypass limits put on your server such as slots or RAM amount your server is subject to being terminated without refund.
TERMINATION
We reserve all rights to terminate your server or service upon any violation of these terms or any other basis if deemed needed. Services which are suspended for non-payment will be terminated 7 days after the renewal invoice is due. We do not terminate services without cause.
Acceptable use Policy
ILLEGAL USE
Bruhhost.com services may not be used for illegal purposes, or in support of illegal activities. Bruhhost.com reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing.
THREATS
Using of the Bruhhost.com services to transmit any material (by e-mail, uploading, posting or otherwise) that threatens or encourages bodily harm or destruction of property. Harassment using of the Bruhhost.com services to transmit any material (by e-mail, uploading, posting or otherwise) that harasses another.
FORGERY OR IMPERSONATION
Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation.
FRAUDULENT ACTIVITY
Use of Bruhhost.com service to make fraudulent offers to sell or buy products, items, or services, or to advance any type of financial scam such as “pyramid schemes” and “chain letters.”
UNAUTHORIZED ACCESS
Use of the Bruhhost.com service to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Bruhhost.com or another entity’s computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data, is expressly prohibited and the offending Bruhhost.com account is subject to immediate termination and further investigation.
NETWORK DISRUPTIONS AND UNFRIENDLY ACTIVITY
Use of the Bruhhost.com service for any activity which affects the ability of other people or systems to use Bruhhost.com services or the Internet. This includes “Denial of Service” (DoS) attacks against another network host or individual user. Interference with or disruption of other network users, services or equipment is prohibited. It is the Member’s responsibility to ensure that their network is configured in a secure manner. A Subscriber may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Subscriber may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner. Unauthorized entry and/or use of another company and/or individual’s computer system will result in immediate account termination. Bruhhost.com will not tolerate any subscriber attempting to access the accounts of others, or penetrate security measures of other systems, whether or not the intrusion results in corruption or loss of data.
FRAUD
Fraud involves a knowing misrepresentation or misleading statement, writing or activity made with the intent that the person receiving it will act upon it. Fraud is strictly prohibited and offenses will be investigated. Third-party Links, Sites and Services Our Products may contain links to third-party websites, advertisers, services, special offers, or other events or activities that are not owned or controlled by Bruhhost.com. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services. If you access any third party website, service, or content from Bruhhost.com, you do so at your own risk and you agree that Bruhhost.com will have no liability arising from your use of or access to any third-party website, service, or content.
PROHIBITED USAGE
Hosting services provided by Bruhhost.com are not to be used for any of the following: pornography, file sharing/repositories/storage, fraudulent activity, extortion or blackmail. Clients utilizing this service may also not upload any sort of malicious scripts/software; this includes the following but not limited to items involving phishing, backdoors, CPU/memory eating scripts and more. The service may only be used for the purpose of hosting a website/web application. It may not be used as a central source for providing clients with mod content (Arma 3, for instance).
DISK RESOURCE USE
Disk space provided in associated with our web hosting services may only be used for files and content indirect operation of the website, web applications pr game servers being hosted. The disk space provided cannot be used for file sharing, storing backups, or anything unrelated to the operation of the website/web application.
Service Level Agreement
Bruhhost.com. agrees to furnish services to the Subscriber, subject to the following (“Terms of Service”). Bruhhost.com, the company hereafter referred to as, (“Bruhhost.com “), (“Us”), (“We”) and The Client, (“Customer”), (“Client”) and (“You”). Use of Bruhhost.com Service constitutes acceptance and agreement to AUP (“Acceptable Use Policy”) and ToS (“Terms of Service”). All provisions of this agreement are subject to change from time to time at the discretion of Bruhhost.com. Subscriber understands that change to the SLA by Bruhhost.com shall not be grounds for early contract termination or non-payment.
1. NETWORK
(“Network”) is defined as all equipment, software and facilities within Bruhhost.com infrastructure, which includes Bruhhost.com contracted and leased services outsourced from its providers, which Bruhhost.com utilizes to provide its web, game server and voice server hosting services.
1.1 SERVICE AVAILABILITY
(“Service Availability”) refers to the total time in a given calendar month that Bruhhost.com infrastructure/network is available throughout the internet, provided that the client and its users have established internet connectivity. Bruhhost.com takes responsibility for the service availability within its own infrastructure, and what it has control over, however cannot be held liable for issues directly related to external providers, which include bandwidth, software or hardware.
1.2 SERVICE DOWNTIME
(“Service Downtime)” is defined as any unplanned interruption in service availability during which the client is unable to access the rented services as described in preceding section 1.1. Provided that the downtime has been confirmed to have been a result of the fault of an issue within the Bruhhost.com infrastructure as confirmed by itself if the downtime is more than 24 hours Bruhhost.com will measure the total length of time of the unplanned service downtime during a calendar month for affected clients. The client is responsible for opening up a ticket requesting it.
1.3 SCHEDULED SERVICE DOWNTIME
(“Scheduled Service Downtime”) is defined as scheduled interruption of service. Scheduled downtime takes place during a Bruhhost.com defined maintenance window, which occurs in conjunction with a 1-hour notice to the client via electronic communication (email). Bruhhost.com agrees to schedule its maintenance procedures to take place during times at which clients will be least affected, and to expedite the procedures to reduce downtime incurred.
1.4 PERFORMANCE CREDIT
(“Performance Credit”) is defined as the amount credited to a client when 100% service uptime is not met. Bruhhost.com will credit the customer 5% of its monthly (pro-rated to monthly if on a term other than monthly) service fee for each 1 hour of service downtime incurred up to 100% of the client’s monthly service (rental) fee. Performance credit, or SLA credit, is issued entirely at the discretion of Bruhhost.com and is only applicable should the service downtime be a result of a direct fault of Bruhhost.com Performance credit is NOT applicable in the case of any sort of service attack (DDoS), hardware failure, software failure, or a failure/issue induced by the client themselves.
1.5 MONITORING SERVICE
(“Monitoring Service”) is defined as the service which Bruhhost.com provides in order to monitor the status of its infrastructure, which includes networks, individual systems and other services. The monitoring service is provided via Bruhhost.com monitoring solutions
2. SUPPORT SERVICES
(“Support Services”) are defined as the services provided by Bruhhost.com to assist clients with the management and utilization of the rented services which Bruhhost.com provides to its clients. Bruhhost.com agrees that its team and representatives will do their absolute best to assist with any matter involving a direct fault of an item within Bruhhost.com infrastructure; this includes game control panel configurations. Bruhhost.com cannot guarantee that it will be able to assist in any matter directly related to the software in which it is hosting for its clients, nor anything which its clients add on or change themselves. Any support offered past what involves issues directed at Bruhhost.com infrastructure is provided entirely under the discretion of Bruhhost.com itself.Generally, this applies to issues with modded/third party content which clients tend to add onto their rented services.
3. Payment
3.1. All game server(s)/dedicated server(s) are paid for in advance.
Failure to keep up monthly payments on your server can result in
suspension and, ultimately, deletion of your game server(s).
3.2. If you decide to cancel a subscription with us, please also
remember to cancel your PayPal subscription, which in some cases does
not auto-cancel.
3.3. Should you need to raise a PayPal dispute, the suspension of
your service may need to be implemented whilst the investigation is
progressing.
